1. Operator and scope

Daleki Merch is operated and invoiced by D-Legacy SAS, RUC 1793077323001, Quito, Ecuador. Contact: dalekimerch@gmail.com and +593 99 785 4652. We offer custom merchandise and quotes for Ecuador.

2. Catalog and reference prices

Catalog amounts are base prices in USD for the uncustomized product, with quantity tiers and product-specific minimums. They are identified as excluding VAT, customization, special packaging and shipping. They do not constitute a final purchase total.

Before accepting an order, we will provide a quote stating unit and total prices, applicable taxes and charges, customization and shipping. No payment is requested through the site bag. Consumer information must make the final amount clear before contracting.

3. Request and order confirmation

Submitting the bag or messaging us on WhatsApp requests a quote. It does not reserve stock, start production or confirm a sale. The team checks availability, technique, destination and timing and confirms accepted terms in writing.

Quote service hours are Monday to Friday, 08:00 to 18:00, America/Guayaquil. The service target is under one business hour. Production and delivery times are agreed in each proposal.

4. Deposit and balance

The proposed commercial condition is a 50% deposit and 50% balance on delivery unless otherwise agreed in writing. It must appear in the accepted quote with verified D-Legacy SAS payment details. Accounts from the previous business are not carried over.

A deposit does not imply a general waiver of returns, warranties or other rights. The effect of cancellation is determined by work progress, the agreement and applicable law.

5. Final artwork and customization

The team prepares production artwork and requests your approval of the product, placement, dimensions, colors, text and technique before manufacturing. Please review spelling and files. Later changes may affect cost or timing and require renewed acceptance.

We do not assume universal physical tolerances. Material and technique limitations and tolerances are confirmed in the proposal or sample.

6. Files and brand rights

By providing a logo, image, text or font, you confirm that you can authorize its use for the order. Authorization is limited to preparing and performing that work. You retain your rights; we will not use your brand in advertising without additional authorization.

7. 3D studio and Merch AI

The 3D render is a concept preview, not a physical sample or production proof. Shape, lighting and color may vary. Customer files are composed by code and are not redrawn by AI.

Merch AI may make mistakes. It does not confirm stock, discounts, dates or final prices, and does not accept contracts. These limitations do not exclude D-Legacy SAS legal responsibilities. You may request human review through WhatsApp.

8. Delivery within Ecuador

The quote states the destination, party responsible for transport, cost and estimated or committed date as applicable. If a delay is expected, the team will inform you and agree on a solution under the contract and law.

We are based in Quito and coordinate nationwide shipping within Ecuador. The destination and delivery terms are confirmed in each quote.

9. Cancellations, changes and returns

Request changes or cancellation through our contact channels and include your reference. The team will explain work progress and provide a documented resolution. Customization does not automatically remove legal rights.

Where article 45 of the Organic Consumer Protection Law applies, the return or exchange right is exercised within the statutory fifteen-day period after receipt, subject to the nature and condition of the goods required by that provision. Its application is assessed without an absolute prohibition solely because merchandise is customized.

10. Quality, warranties and claims

If units differ from approved artwork or terms, are defective or arrive damaged, contact us with the reference and available evidence. We will assess repair, replacement, refund or another appropriate solution. Photos help process a claim; failure to report immediately does not require a waiver of rights.

Statutory warranties and mandatory remedies prevail. No clause limits liability that cannot legally be limited.

11. Law, disputes and updates

Ecuadorian law and mandatory rules applicable to the relationship and destination apply. We will seek a written resolution without preventing access to competent authorities or courts or imposing mandatory arbitration.

Terms accepted for an order do not change retroactively when this page is updated. This text is a draft for review before launch.
